Acceptable Use Policy

Rules for fair use.

This Acceptable Use Policy (“AUP”) describes what is and is not allowed when using NextSafe. It forms part of our terms and conditions. In short: use the service lawfully and respectfully and you will always be fine.

  • Lawful use, within the law and this policy.
  • No abuse, fraud or harm to others.
  • Enforcement: if you break the rules we may suspend or terminate.

01 Scope: our service and who is covered

NextSafe is a brand of Nextmac B.V. (Chamber of Commerce 98868950, Herengracht 320, Amsterdam). We provide a consumer VPN service: encrypted internet connections through servers operated by us or our infrastructure partners, with apps for macOS, iOS, Windows and Android among others, and an online account area.

This policy applies to everyone who uses our service or website: account holders, people who use the service through an account holder’s account, and visitors to our website.

02 Permitted use

NextSafe is intended for personal, lawful use. Think of: protecting your privacy, browsing safely on public wifi networks, choosing which country your connection runs through and securing the devices in your household. We ask you to make reasonable use of network capacity so the service stays fast for everyone.

03 Prohibited use

You may not use NextSafe for or in connection with:

  • activities that violate Dutch or European law, or the law that applies to you;
  • gaining unauthorised access to systems or accounts (hacking), network attacks, DDoS attacks or port scans;
  • distributing malware, viruses or other harmful software;
  • spam, phishing, scams or fraud, including payment fraud and identity abuse;
  • infringing the intellectual property rights of others;
  • material involving the sexual abuse of minors; this is absolutely forbidden and will be reported to the competent authorities upon discovery;
  • threatening, stalking or intimidating individuals;
  • reselling or commercially sharing the service without our written permission;
  • any other use that harms our infrastructure, reputation or other users.

04 Compliance with laws and sanctions

You are responsible for complying with the laws and regulations that apply to you. The service may not be used from or on behalf of persons, organisations or countries subject to sanctions of the European Union, the United Nations or other applicable authorities. We refuse, restrict or terminate service where laws or sanctions regulations require us to do so.

05 Rules for your account and our platform

Your account is personal. Keep your login details safe and do not share them outside your household. Provide accurate details when signing up and keep them up to date. You may not circumvent technical limitations of the service, abuse promotions or payment processes, or use the service in a way that facilitates abuse, fraud or harmful content. If you suspect someone else has access to your account, report it immediately via support@nextsafe.nl.

06 Responsibility for third parties

As the account holder you are responsible for all use of the service through your account and devices, including by household members or others you give access to. A violation of this policy by such a user counts as a violation by you as the account holder.

07 Monitoring and enforcement

We do not monitor the content of your internet traffic and do not store browsing activity. Enforcement of this policy is based on abuse reports from third parties, technical signals at account and network level (such as security incidents or extreme load) and checks around payments.

In case of a (suspected) violation we may, depending on severity: warn you, restrict functionality, or temporarily suspend or terminate your account, without refund to the extent permitted by law. Where legally required, we cooperate with the competent authorities.

08 Reporting abuse and changes
